Dividing Of Assets

Going through a separation or divorce can be a very stressful and emotionally challenging. Navigating your way through this period of time can be difficult, as it is unclear what your future holds. Especially when it comes to knowing how to separate your lives, including your assets shared through the marriage/relationship.


Every marriage and relationship is different and completely personal to the people involved, therefore there are unfortunately no set in stone rules regarding division of assets when it comes to processing your divorce/separation.



When you assets are required to be divided between both parties, both the Court and solicitors will take into account various factors known as Section 25 factors.


Factors include (but not limited to):


  • The standard of living your family had before the breakdown of marriage.
  • The financial obligations, needs and responsibilities which each spouse has or is likely to have in the foreseeable future.
  • Income and earning capacity, property and other financial resources that each spouse has or is likely to have the foreseeable future.
  • The ages of each spouse and the duration of the marriage.
  • The contributions that each spouse has made or is likely to make in the future to the welfare of the family.
  • The conduct of each spouse, if that conduct is such that is would be unfair to disregard in the opinion of the Court.
  • The value of each benefit to each spouse of any benefit that one spouse would lose as a result of the divorce.


As you can see there are multiple factors involved when it comes to the dividing of assets as a result of a divorce or separation and each comes with their own individual circumstances.

  • What are the grounds for divorce?

    There are 5 main grounds for divorce:

    1. Adultery
    2. Unreasonable Behaviour
    3. Desertion
    4. Living Apart for More Than 2 Years
    5. Cruelty
  • What are my rights to see the children?

    Ensuring the children are in no risk of harm, contact rights will be ordered by the court. However contact rights are the right of the children not the parent.

  • Do I have to attend mediation?

    You don’t have to attend mediation if all family and divorce matters have been agreed on.

  • What type of court orders can be made regarding children?

    There are three main court orders regarding children:


    1. Child Arrangement Order
    2. Prohibited Steps Order
    3. Specific Issue Order
  • Do I have to go to court?

    Court is usually seen as a last resort. If your divorce is agreed them it will go through the court as paperwork, if it is not agreed you will have to attend.

  • What am I entitled to?

    This all depends on individual circumstances, such as wether your married or living together.

  • What happens in a mediation meeting?

    You will meet with a mediator individually to discuss open and honestly your circumstances and situation. You will then be bought together for a joint meeting.
