Dean from West Mercia telephoned us confirming they had received an anonymous tip off that one of their employees had been stealing fuel from them. We explained to the company the requirements of the ACAS Code of Practice, what the tribunal would expect from it and how best to limit its risk in carrying out the disciplinary process. A very full and thorough investigation was carried out and a disciplinary process conducted which resulted in a dismissal and appeals process. We supported the company by advising on the content of letters, proof reading letters, advising on process, minimising risk and advising on possible improvements that could be made for the future. The employee was dismissed and did not bring a claim.
